Rationale

To fulfill Saint Cloud State University’s (SCSU) mission and vision, programs that engage the citizens of our state, including minors, are an integral part of the operation of the university. This policy will outline the requirements placed on all persons interacting with minors, to fulfill our legally mandated obligations while further ensuring that we are providing the best possible experience for any minor visiting SCSU controlled grounds or SCSU sponsored events off campus.

 

Policy

This policy outlines the expectations and practices related to minors who are not enrolled in courses for credit at SCSU, but who are present on the campus of SCSU or are participating in programs offered by the University in any location.

All programs and activities that involve minors, including programs operated by the University, programs operated by third-party entities on SCSU controlled grounds, and programs that are under the direction and authority of SCSU at locations off campus fall under the purview of this policy. Any specific situations not directly addressed by this policy will be addressed by the appropriate University official on an individual basis as necessary. 

Guests and visitors to SCSU who are 17 years and younger are considered minors (see Definitions).  

Violations of this policy will be addressed through applicable University policies, procedures, and/or contractual agreements.

 

Bringing Your Minor Child into the Workplace

Employees are welcome to bring their children to their workplace for brief visits on an occasional basis providing that all relevant sections of this policy are followed and that the presence of the minor does not unduly require the employee’s attention or disrupt the work environment.

 

Classrooms, Labs and Academic Spaces 

The University does not allow individuals who are not enrolled in a course to attend classes without specific permission.

Due to the potential for disruption, both instructors and students should refrain from bringing minors to class. Further, minors are prohibited from entering a lab or other class area that is hazardous in nature; or when the material being covered or activities are inappropriate for a minor, as determined by the course instructor.

 

Expectations of Minors’ Behavior

Non-enrolled minors, including prospective students, participating in events on campus or events sponsored by the University are required to act in a manner consistent with the behavioral expectations of the activity or event in which they are engaged. This includes, not causing a disruption and following the written or verbal directions of the event or activity leaders as well as following all posted safety rules on campus. Violations of these expectations may result in program staff or event leadership contacting the minor’s parent or guardian for immediate pick up and removal from the event or activity.

 

Mandated Reporting

St Cloud State University employees and all individuals within the scope of this policy are required to report any observed neglect, physical abuse, or sexual abuse of a child immediately (within 24 hours) according to Minnesota Statute 626.556 Subdivision 3. This includes reporting any knowledge of, or reason to believe that, neglect, physical abuse, or sexual abuse is occurring or has occurred within the last three years. Event Space Reservation

Space for an event must be reserved through the venue-appropriate reservation system. Typically, this will be the University’s EMS system. An event must also create and maintain an event safety plan which should include: 

  • Emergency contact information for attendees
  • Plans for supervision of minors
  • Conduct rules for event staff/volunteers and participants
  • And a review of the safety standards for the space in which the event takes place, including emergency evacuation routes.

Adherence to the Best Practices located in the guideline section (below) is encouraged.

 

Background Checks

Criminal background checks must be completed for positions with job responsibilities that include working with children, consistent with Minnesota State guidelines, in consultation with Human Resources.

The University may accept successful documented criminal background clearances from governmental agencies (e.g., school districts) that have been completed with three years from the start date of the activity.

Background checks will not be required when the event is limited to classroom, laboratory or other non-private spaces, is open to the public (including by invitation) or in collaboration with youth organizations or schools in the region, where participants will have chaperones or advisers.

 

Transportation

All activities requiring transportation are subject to MMB driver and fleet safety standards and MN State policies and procedures. Transportation of minors is subject to additional restrictions and requirements. See Procedures and supporting documents.

 

Volunteers

Volunteers must complete the appropriate form and agreement/release based on the type of assignment they will be performing or service they are providing. (See Related SCSU Policies for the link to the Volunteer Policy. Forms can be found in the Supporting Documents section.)

Criminal background checks are not needed if a third party managing the event assumes responsibility for the actions and background checks of its volunteers.

A criminal background check is needed if the volunteer will:

  • Have unsupervised access to minors
  • Process credit card, cash, or other financial transactions
  • Have access to residence halls

Volunteers are expected to follow this policy and procedure, including the requirement to report signs of negligence and/or abuse of any kind.

 

Third Party Events, Activities, and Rentals

When minors come to campus as guests, invited to participate in events sponsored by a non-university entity, they are expected to follow the guidance and instructions of the event sponsors, as well as the rules of the University and applicable law. The non-university sponsor is obligated to uphold the terms of their agreement with SCSU and is responsible for assuming supervision and safety of minors. Please see procedures for a non-exhaustive list of requirements for third parties.

 

Exceptions

Activities and programs organized, managed, or run by a non-university third party may have exceptions to certain requirements of this policy or procedure due to language in contracts or agreements that transfers responsibility and/or liability to the third-party entity.

The following activities or situations are exempt from this policy

  • Where Minors are currently enrolled at SCSU or living in a SCSU dorm as enrolled students at the St Cloud Technical and Community College.
  • Where Minors are employed by the U
  • When Minors are part of IRB approved research.
  • When Minors attend the licensed on-campus daycare (Lindgren Early Learning Center)
  • Public events such as sporting events, theater productions, commercial businesses or University spaces and events open to the general public.
  • Events or activities in which the primary responsibility for minors does not transfer to University staff or faculty. Typically, these are sponsored visits or events where minors are accompanied by organization staff or chaperones
  • When Minors participate in services offered by Centers, clinics, or other units on campus that provide services to minors or may have minors present under supervision of a guardian, parent, or responsible adult such as the Speech-Language and Hearing Clinic, Miller Center or the Community Garden.
  • Practicums, clinical experiences, student teaching or other events in which students interact with minors at locations off-campus and under the supervision of a third party.
 

Procedure

Supervision

For events or programs in which SCSU is responsible for supervision of minors, commonly accepted supervisory ratios must be followed (See Supporting URLs). Supervisors must also adhere to specific standards of behavior as found in the procedure.

For all other events, any individual under the age of 18, unless enrolled at SCSU, are limited to publicly available spaces. It is recommended that minors be accompanied by a responsible adult such as a parent, legal guardian, adult sibling, or entrusted caregiver.

Unaccompanied minors on campus interfering with the Universities mission or causing disruption will be asked to leave University property.

 

Transportation: 

  • The State of Minnesota requires that only employees who are eligible drivers can operate motor vehicles as part of their work for SCSU. When travel is part of a SCSU sponsored event or program only eligible drivers are permitted to transport other participants.
  • Safe travel plans shall be made by the entity arranging the event or program.
  • If a University employee will be involved with the transportation of a minor(s) for, or related to, an event sponsored by the University or a school, college, department, unit, center, office or other University division, details of this transportation must be reported to the Director of Risk, Safety, Emergency Management and Parking. The driver of the vehicle, whether the vehicle is state owned, a rental vehicle, or a personal vehicle, shall submit a Vehicle User Agreement and follow all the regulations included in the agreement. The agreements can take 7-10 working days to process, and no transportation of minors shall take place until a notification of approval has been received.   • For security of all parties, a University employee shall not transport a minor alone. There must always be at least three individuals in the vehicle when employees are transporting a minor unless said minor is the employees own child.
  • Use of seatbelts is required for all passengers.
  • When transporting minors as part of a University sponsored activity or event, eligible drivers must ensure a University employee or volunteer, over the age of 18 who is involved with the event or program is present to provide supervision.

 

General Provisions for Bringing Your Minor Child to the Workplace:

  • The minor is always under the employee or their designated caregiver’s direct supervision.
  • Employees are not allowed to request other employees provide supervision at any time.
  • Minors are expressly forbidden from entering any hazardous, private or restricted areas, unless they are an enrolled student in a class which would be an exception to this policy
  • Questions about bringing your child into your workplace should be directed to your supervisor or Human Resources.

Provisions for Bringing a Minor into Classrooms, Labs and Academic Spaces:

  • The instructor has granted the student parent permission to bring a minor to class
  • Minors are invited to participate in the class or activity in support of an academic goal or to meet a learning objective
  • The minor is enrolled as a student
  • Minors, other than enrolled students, must be always supervised by their parent/guardian if they are allowed into the classroom under these provisions.

All programs and activities that involve minors will follow the below rules when hosting minors on campus:

 

Rules for Working with Minors
  • Minors must be always supervised by either a legal guardian or an adult authorized by this policy to supervise minors while participating in a program, event, or performance
  • The Sponsoring Department/Office of SCSU must ensure that all minors and authorized adults abide by all University regulations and activity and/or event rules.
Adults working with or supervising minors must:
  • Respect privacy in situations such as changing clothes, showering or using the restroom, except where health and safety reasons require such intrusion
  • Maintain professional, kind and courteous conduct at all times, avoiding rude, abusive or bullying behavior
  • Meet with minors only within established times for registered activities and/or events
  • Never be under the influence of alcohol, drugs, or other illegal substances during an activity or event involving minors

 

Obligations of Third Parties:

Third parties must:

  • Sign an agreement that indemnifies the college or University from legal action taken as a result of the negligence of camp operators and their staff.
  • Ensure that all materials advertising the camp clearly distinguish the camp operator (the third party) from the camp location (college or University campus).
  • Immediately report All incidents of violence, neglect, sexual misconduct, or other SCSU policy violations must be reported to SCSU Public Safety and/or the St Cloud Police Department as appropriate

 

Guidelines

Best Practices for Events that include Minors:

  • Communication and Notification – The sponsoring department shall establish an appropriate procedure for the notification of the minor’s parent/legal guardian in case of an emergency, including behavioral problems, natural disasters, or other significant program disruptions.
  • Medical Treatment, Administration of Medicines and Emergency Services – The sponsoring department shall develop a plan for the administration of medications as well as ensure that directions are readily accessible to staff and volunteers on how to summon emergency services.
  • Supervision of Minors and Access to University Facilities – Each sponsoring department will develop a plan outlining the supervision of the minors and what their access to University facilities will be. The plan will include such things as an adult to participant ratio, the activities involved, a housing plan (if attendees will be staying overnight), a program staff training plan, and the responsibilities of program staff.
  • Program Rules of Conduct – Program staff will develop and make available to participants the rules and disciplinary measures applicable to the program; this will include a copy of the Student Code of Community Conduct.
  • Liability – Program staff shall obtain an Assumption of Risk, Waiver of Liability, Indemnification, and Release form as part of the program registration process.
  • Background Checks – All program staff and volunteers who have direct contact with minors or supervise a program with minors are required to have a background check on record with the University before the adult is hired or allowed to engage with minors.
    • Background checks for University employees and volunteers will be conducted by Public Safety, and these checks must be cleared prior to the beginning of the activity/program. The background checks will be conducted through the Minnesota Bureau of Criminal Apprehension.  If the program member has lived outside of Minnesota within the past ten years, a fingerprint background check will be required to check other states.
    • Subsequent background checks will be required every three (3) years for employees who return to a covered program or activity, volunteers must have a clear background check successfully completed every 12 months

Address the following in clear and explicit terms in communications with parents/guardians, in applications and in exculpatory/assumption of risk documents:

  • Unscheduled free time and who has duty to supervise
  • Transportation risks
  • Internet access if it will be available
  • Safety precautions: secure room doors and exterior doors providing access to participants, do not block doors open or leave unlocked.
  • Prohibited conduct, underage drinking, hazing, sexual misconduct, with a clear statement that a minor may be immediately dismissed from the program and parents contacted to pick up a minor for violation of safety rules

Provide notification to the Department of Public Safety of the location, dates, and times when minors will be present in University facilities so that emergency evacuation plans can factor in any special consideration arising out of the presence of minors.

 

Adults should always maintain proper boundaries including:

  • Refraining from activities with or in the presence of minors that may be reasonably interpreted as inappropriate, in violation of established SCSU and/or Minnesota State system policies or in violation of the law.
  • Limiting any one-to-one communications with a minor through any method (email, text message, telephone, social media, etc.) to academic or programmatic needs
  • Photographing or making videos of minors only for Program-related purposes and only after the minor’s legal guardian has signed the appropriate consent and waiver
  • Respecting privacy in situations such as changing clothes, showering or using the restroom, except where health and safety reasons require such intrusion
  • Maintaining professional, kind and courteous conduct at all times, avoiding rude, abusive or bullying behavior
  • Meeting with minors only within established times for registered activities and/or events

 

Residence Halls:

Within one month of the start of an event in which minors will be staying overnight in a residence hall a premises safety risk assessment must be completed, keeping in mind safety issues for the age group that will be staying in the residence hall if not a typical college cohort.
